1. About Us
These terms govern your use of the Hypernova One website and any services we provide. By using the site you agree to these terms.
2. Services & Pricing
All Hypernova One engagements are custom-priced based on scope, complexity, region and timeline. No price displayed or quoted by the chatbot is binding until confirmed in a written proposal signed by both parties.
3. Acceptable Use
You agree to use the site lawfully and in good faith. You may not, and may not attempt to: (a) gain unauthorised access to any part of the site, our systems, or another user's data; (b) probe, scan, or test the vulnerability of the site without prior written permission; (c) submit prompts or content designed to bypass safety controls, extract system prompts, or cause our AI assistant to behave outside its scope; (d) submit unlawful, infringing, defamatory or harmful content; (e) interfere with the operation of the site, including via automated scraping, denial-of-service activity, or excessive request volume.
4. AI Assistant ("Nova")
Our website includes an AI concierge ("Nova") provided to help qualify enquiries. Nova's responses are generated by automated language models and, while constrained to Hypernova One topics, may occasionally be inaccurate, incomplete or out of date. Nova does not provide legal, financial, medical, tax or other professional advice. Nothing said by Nova constitutes a binding offer, quote, commitment, guarantee or contract. Only a written proposal signed by an authorised representative of Hypernova One is binding on us.
5. Information Security
We apply current industry-standard safeguards to protect the site and your personal information, as detailed in our Privacy Policy. While we continuously review and improve these safeguards, no internet-based service can be guaranteed 100% secure. By using the site you acknowledge this inherent risk and agree to submit only the information reasonably necessary for your enquiry.
If you discover a potential security vulnerability, please disclose it responsibly by emailing hello@hypernovaone.com before disclosing it publicly. We appreciate good-faith research and will not pursue legal action against researchers who comply with this clause.
6. Disclaimer of Warranties
The site and the AI assistant are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we make no warranties, express or implied, regarding uninterrupted availability, accuracy, fitness for a particular purpose, or non-infringement.
7. Limitation of Liability
To the fullest extent permitted by law, Hypernova One, its directors, employees and contractors shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, goodwill or business opportunity, arising out of or in connection with your use of the site or the AI assistant, even if advised of the possibility of such damages.
Nothing in these terms excludes or limits our liability for: (a) gross negligence or wilful misconduct; (b) death or personal injury caused by our negligence; (c) any liability that cannot lawfully be excluded under POPIA, the Consumer Protection Act, or other applicable South African law.
8. Indemnity
You agree to indemnify and hold Hypernova One harmless from any claim, loss or expense arising out of your breach of these terms, your misuse of the site, or your unlawful use of any output generated by the AI assistant.
9. Changes to These Terms
We may update these terms from time to time. Continued use of the site after changes are posted constitutes acceptance of the updated terms.
10. Governing Law & Jurisdiction
These terms are governed by the laws of the Republic of South Africa, and any dispute arising from them is subject to the exclusive jurisdiction of the South African courts.
11. Intellectual Property
All branding, content and code on this site is owned by Hypernova One unless otherwise stated. You may not reproduce, modify or redistribute it without our prior written permission.
